Thirty-three companies that recorded losses or no profit over a seven-year period donated a total of Rs 581.7 crore through electoral bonds, of which Rs 434.2 crore was encashed by the Bharatiya Janata Party, an analysis by The Hindu and an independent research team has revealed.

In all, the analysis casts suspicions on the sources of funding of at least 45 companies that bought electoral bonds despite recording losses or no profit between the financial years 2016-’17 and 2022-’23. These 45 companies have been organised into four categories: A, B, C and D.

Companies in Category A and B made significant donations through electoral bonds despite the absence of profits. They may be fronts for other firms or could have misreported their profits and losses in an attempt to launder money, the analysis suggests.

The net losses of the 33 companies that donated Rs 576.2 crore – Category A – over a seven-year period stood at over Rs 1 lakh crore, with 16 of them, including Bharti Airtel and Piramal Capital and Housing Finance Limited paying zero or negative direct taxes in aggregate, The Hindu reported.

Another six companies – Category B – donated a total of Rs 646 crore, of which Rs 601 crore was encashed by the BJP. These companies bought electoral bonds worth…

A special court in Mumbai on Wednesday said that the absence of Bharatiya Janata Party leader Pragya Thakur in the court is hampering the proceedings in the 2008 Malegaon blast case and directed the National Investigation Agency to verify her health status, The Indian Express reported.

The special court is currently recording the statements of the seven accused, including Thakur, in the case.

On Wednesday, the special judge AK Lahoti said that Thakur, who is the main accused in the case, has been absent from the proceedings for a long time, and considering her medical condition, she was allowed to leave even when she appeared before it on March 22.

“Thereafter, before departing to Bhopal, she did not turn back in court for recording her statement,” the court said. “The presence of accused no. 1 [Thakur] is necessary to record her statement… Due to her absence, it is hampering the court proceedings.”

On March 11, the court issued a bailable warrant against the BJP MP from Bhopal. The warrant was cancelled after she appeared before the court on March 22.

On Wednesday, Thakur’s lawyers sought exemption from her appearance in the court citing health reasons. They said she was suffering from serious ailments and her doctors in Bhopal have advised her to rest.

The Supreme Court on Tuesday granted Patanjali Ayurved’s Managing Director Balkrishna and co-founder, yoga guru Ramdev, a last opportunity to file affidavits of compliance in the contempt proceedings initiated against the company for its “misleading advertisements”, PTI reported.

A bench of Justices Hima Kohli and Ahsanuddin Amanullah also criticised the company for the affidavit submitted by Balkrishna on March 20, apologising for releasing the advertisements and said that it was a “gross violation of the undertaking given to the top court”, Bar and Bench reported.

On March 20, Balkrishna had tendered an “unqualified apology” and said that he had the highest regard for the rule of law, adding that Patanjali Ayurved would ensure it did not issue any such advertisements in the future.

He also said that the company’s media wing was not aware of the Supreme Court’s order halting the broadcast of such advertisements, Bar and Bench reported.

The petitioner in the case, the Indian Medical Association, alleged that Patanjali Ayurved has carried out a “smear campaign” against modern medicine and the Covid-19 vaccination drive.

The apology came a day after the top court ordered Balkrishna and Ramdev, to appear before it in person. The court passed the order after the yoga guru failed to respond to a show cause notice in contempt proceedings initiated against his company.

The bench had asked the…

The Delhi Police Special Cell on Saturday filed an 8,000-page chargesheet in the Unlawful Activities Prevention Act case against NewsClick founder and editor Prabir Puryakayastha, who has been in judicial custody since November.

Purkayastha and NewsClick’s parent company PPK NewsClick Studio Pvt. Ltd. have been named as accused parties that allegedly received funds through Chinese entities “with the intention of undermining India’s sovereignty and territorial integrity”.

The Delhi Police had on October 3 raided several journalists associated with NewsClick and arrested Purkayastha and Amit Chakraborty, NewsClick’s head of human resources. In January, a Delhi court allowed Chakraborty to turn approver – or act as a government witness – in the case filed under the Unlawful Activities (Prevention) Act.

Non-profit organisations Reporters Without Borders and Guernica 37 Chambers on Wednesday called on the European Union to sanction four high-ranking officers of the Delhi Police for “exactions” against journalists associated with news website NewsClick.

Without naming the police officers, the organisations said that they ordered raids on the homes of 46 journalists associated with NewsClick in Delhi and surrounding towns in October.

Purkayastha had appealed to the Supreme Court after the Delhi High Court on October 13 dismissed a petition against his and Chakraborty’s arrest. The High Court had said that their actions “directly impact the stability, integrity and sovereignty of the country”.

Merely possessing certain literature which might be used to propagate violent actions cannot be charged as a “terrorist act” under the Unlawful Activities (Prevention) Act, the Supreme Court said on Friday, reported Bar and Bench.

A bench of Justices Aniruddha Bose and Sudhanshu Dhulia made the observation while granting bail to activists Vernon Gonsalves and Arun Ferreira in the Bhima Koregaon case.

The National Investigation Agency had cited letters and other materials recovered from co-accused activists Surendra Gadling and Rona Wilson to allege that Gonsalves and Ferreira had links with the banned outfit Communist Party of India (Maoist).

However, the court held that none of the materials established that the two activists indulged in activities that could amount to “overawing any public functionary by means of criminal force”.

“The copies of the letters in which the appellants or any one of them have been referred, record only third-party response or reaction of the appellants’ activities contained in communications among different individuals,” the court observed, according to Bar and Bench.

The Uttar Pradesh government has told the Supreme Court that it is investigating security lapses that led to the killing of gangster-turned-politician Atiq Ahmed and his brother Ashraf Ahmed in custody, reported Live Law.

On April 15, Atiq and Ashraf Ahmed were shot dead in the presence of police officials when they were being taken for a medical check-up at a hospital in Prayagraj. On April 13, Atiq Ahmed’s 19-year-old son Asad Ahmed was also killed in an alleged gunfight with the Uttar Pradesh Police.

The Supreme Court had sought a comprehensive affidavit from the Uttar Pradesh government on the steps taken to inquire into the matter. The direction was issued in response to a petition filed by advocate Vishal Tiwari seeking an independent inquiry into the killings.

The state government told the top court in an affidavit that it constituted a three-member inquiry commission, which was later upgraded to a five-member panel, headed by the Allahabad High Court’s former Chief Justice DB Bhonsle. The commission is yet to complete its inquiry and has been granted an extension till September 24, reported Live Law.

“On the basis of prima facie reports from the relevant ACPs [Assistant Commissioner of Police], four of the police officers present on the scene and the SHO [Station House Officer] of PS…

The Lucknow bench of the Allahabad High Court on Wednesday suggested that even a short documentary on the Quran with discrepancies would cause a stir, Bar and Bench reported.

“If you make even a short documentary on the Quran depicting wrong things, then you will see what can happen,” a bench of Justices Rajesh Singh Chauhan and Shree Prakash Singh said while hearing petitions against the Hindi film Adipurush.

The judges, however, clarified that the court was concerned about the sentiments of all religions equally and they should not be depicted in a bad light.

Directed by Om Raut, Adipurush is an adaption of the Hindu epic Ramayana. It stars Prabhas, Saif Ali Khan, Kriti Sanon, Sunny Singh and Devdutta Nage.

The film has been criticised on social media for its gangster film-style dialogue, the over-reliance on visual effects and its casting choices. Many pointed out that the dialogues in the film are not only anachronistic to the period setting but also disrespectful of the source material.

Protests were also held across India against the film. Following the criticism, the makers of Adipurush announced that they will rewrite portions of the dialogue and issue new versions of the film.

On Wednesday, the Allahabad High Court said that it has come across several films in recent times wherein Hindu gods have…

In the last one month, Saba Khan, 38, a former journalist, who lives in North Karnataka, has been called a whore, a slut, a spy, an apostate, among other names, on social media.

The vitriol started after she posted a tweet on May 15, calling out a group of Muslim men seen reprimanding two hijab-clad Muslim women for walking with a Hindu man in a market.

“They are showing their power on girls,” Khan tweeted, referring to a video of the incident that took place in Meerut on May 13. In the video, which was shared on many social media accounts, the men accost the women and yank off their face masks to reveal their identity. The women, who looked visibly uncomfortable, are heard saying that the man accompanying them was their colleague.

On May 15, the Meerut police registered a case and arrested six Muslim men in connection with the incident.

Since her tweet, Khan has been targeted on social media almost every day for supporting what is called the “bhagwa love trap” or “saffron love trap”, and purportedly enabling the arrests of the Muslim men.

She is not the only one. Nabiya Khan, a Delhi-based activist, was forced to briefly deactivate her Instagram account after she…

The Kerala High Court on Thursday stayed the proceedings in a sexual harassment case against Malayalam actor Unni Mukundan, Bar and Bench reported.

A bench of Justice K Babu passed the order after the court was told that a settlement has been reached between the complainant and the actor.

This is the second time the High Court has stayed proceedings in the case before the Magistrate court.

The woman had filed a police complaint accusing the actor of sexual harassment in 2017. She alleged that Mukundan molested her when she went to his home for a script-reading session. Mukundan also filed a case against the woman, alleging that she has cooked up the charges.

In May 2021, the Kerala High Court had stayed the trial proceedings based on an affidavit about a purported settlement between the parties.

However, the order was lifted in February after the complainant told the court that the stay had been issued on the basis of a false submission by the actor’s lawyer.

The complainant had said that she did not sign the affidavit.

On May 23, the High Court had refused to quash the criminal proceedings against Mukundan and directed that the lower court should dispose of the case within three months, according to Bar and Bench.

“Any photos?”

“No,” the woman said quietly.

“Any video?”

“No,” she replied, then added, “Do you think somebody after rape makes a video?”

This is how the Associated Press in October last year reported on an exchange in court between Alan Jackson, the lawyer for former film producer Harvey Weinstein, and the woman – identified as “Jane Doe 1” – who accused Weinstein of raping her at a hotel room in Los Angeles in 2013.

Jackson, in his closing arguments defending Weinstein during a trial in Los Angeles, said that the prosecution’s case could be summed up as “take my word for it”.

A similar question has surfaced during the investigation into sexual harassment allegations by India’s top wrestlers against Wrestling Federation of India President Brij Bhushan Sharan Singh.

On June 11, The Indian Express reported that the Delhi Police had asked the wrestlers to submit any photographic, video and audio evidence available with them. This prompted criticism that the police were placing the burden of proof on the wrestlers.

The police, however, clarified that they were “trying to collect the smallest evidence available in the possession of the accused as well as the victims.”

The recent developments have brought to the fore questions about how to prove sexual offences in a court. Scroll spoke to lawyers and legal experts who specialise in such…

The Maharashtra Police and devotees of the Warkari sect got into an altercation in Pune on Sunday, reported NDTV. The Opposition parties have claimed that the Warkaris, devotees of Hindu deity Vithoba, were baton-charged by the police – as can be seen in a video. However, the police and government have denied the charges.

Pimpri Chinchwad Police Commissioner Vinay Kumar Choubey said that the police were allowing devotees to enter the temple in batches of 75, but some of them breached the barricades and tried to jump the queue.

“There was an altercation when police tried to stop them [those forcibly entering the temple],” Choubey said, refuting allegations of baton-charge.

Opposition parties have, however, targeted the government on the incident.

“The pretensions of the Hindutva government have been exposed,” tweeted Shiv Sena (Uddhav Balasaheb Thackeray) MP Sanjay Raut. “The mask fell off. How was Aurangzeb behaving differently? Mughals have reincarnated in Maharashtra.”

Around 9 pm on Thursday, Delhi-based activist Nadeem Khan shared a poster with journalists on WhatsApp asking them to attend an event marking 1,000 days of the incarceration of activist Umar Khalid. Khalid has been behind bars since September 13, 2020, under the draconian Unlawful Activities Prevention Act, for his alleged involvement in the Delhi riots earlier that year.

The poster titled “Democracy, Dissent and Censorship: A Discussion by Concerned Citizens” said the event was scheduled for 3 pm on Friday. The venue: the Press Club of India at Raisina Road in New Delhi.

Only days earlier, Khan had sent out a similar poster for the event, but with a different venue: the Gandhi Peace Foundation at Deen Dayal Upadhyay Marg near ITO in the national capital. The poster, too, had a slightly different title: “Dissent Under Trail: 1000 days of Injustice”.

But on Thursday, the IP Estates Police Station wrote to the office-bearers of the Gandhi Peace Foundation, a charitable trust, telling them to cancel the booking for the event, according to a copy of the letter accessed by Scroll.

This was not the first time in recent months that the Delhi Police has acted to shut down a discussion of this sort.

Those who died on Friday were identified as a 67-year-old woman named Domkhohoi Haokip, a 37-year-old man named Jangpao Touthang and a 52-year-old man named Khaimang Guite, according to Thongkhup Doungel, the younger brother of the Khoken village chief.

The Bihar government has issued a show-cause notice to a construction company after an under-construction bridge collapsed in the Bhagalpur district on June 4, PTI reported on Tuesday.

“The Haryana-based company, which was awarded the contract, has been served with a show cause notice by the Managing Director of Bihar Rajya Pul Nirman Nigam and asked to reply within 15 days,” said Pratyay Amrit, additional chief secretary for the Road Construction Department.
